These Terms of Service (“Terms”) are an agreement between you and ziphoenix (“we”, “us”) for your use of the Healthify mobile app (“the app”). By creating an account or using the app you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the app.
1Who can use Healthify
- You must be 18 or older and able to enter a binding agreement.
- The app is for personal, non-commercial use.
- Do not use the app if you are advised by a health professional not to track your weight or calories, or if you have, or may have, an eating disorder. Please seek professional support instead.
2Your account
- You can sign in with Google or with an email address and password.
- Give accurate information and keep your login details secure. You are responsible for activity on your account.
- Tell us promptly at info@ziphoenix.com if you think someone else has accessed your account.
3Not medical advice
- BMI is only a screening measure. It does not account for muscle, bone, age, body shape or other factors.
- Calorie targets, calorie values and portion sizes are estimates and can be wrong. Real needs vary from person to person.
- Foods found by online lookup are marked as unverified. Please check them before relying on them.
- Talk to a doctor or registered dietitian before starting or changing a diet, especially if you are pregnant or breastfeeding, have diabetes, kidney disease or another medical condition, or take medication.
- Stop and seek medical help if you feel unwell. In an emergency, contact your local emergency services.
4No guarantee of results
We do not promise that you will lose, gain or maintain any amount of weight. Results depend on many things outside the app’s control.
5Acceptable use
You agree not to:
- use the app unlawfully, or to harm, harass or deceive anyone;
- try to access another person’s account or data, or probe, disrupt or overload our systems;
- reverse engineer, copy or resell the app, except where the law allows it;
- use automated tools to collect data from the app or its services.
6Your content and data
The information you enter (such as your weights and food log) remains yours. You give us permission to store and process it only to run the app for you, as described in the Privacy Policy. You can delete your data or your account at any time from the Profile tab or on our account deletion page.
7Third-party services
The app relies on third-party services, including Google Firebase for sign-in and storage, Google Sign-In, and, for optional food lookup, a Google Search page. Their availability and terms are outside our control, and your use of them is also subject to their terms.
8Our rights
The app, its design, the Healthify name and logo, and its content belong to us or our licensors. We give you a limited, personal, non-exclusive, non-transferable licence to use the app. Nothing in these Terms transfers any ownership to you.
9Availability and changes
We work to keep the app running but do not promise it will always be available or error-free. We may change, suspend or stop features, or update these Terms. If we make important changes we will tell you in the app. Continuing to use the app after a change means you accept it.
10Ending your use
You may stop using the app and delete your account at any time. We may suspend or close an account that breaks these Terms or that we reasonably believe is being misused.
11Disclaimer and limits on liability
The app is provided “as is” and “as available”. To the fullest extent the law allows, we do not give any warranty about accuracy, reliability or fitness for a particular purpose, and we are not liable for indirect, incidental or consequential loss, or for any loss arising from decisions you make about your diet or health using the app. Nothing in these Terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
12Governing law
These Terms are governed by the laws of the country where the publisher of the app is established, and the courts of that country will have jurisdiction, subject to any consumer rights you have under the laws of the place where you live that cannot be waived.
